1. HOW TO RECEIVE A GAME CARD: NO PURCHASE NECESSARY TO ENTER OR WIN. Abreva® 100 Days of Summer Scratch & Win Game" ("Game") starts 2/1/08 and ends 10/31/09 or while supplies last, whichever occurs first. Game Cards are available two ways while supplies last: Either: (A) Receive a Game Card when you purchase a specially marked package of Abreva Cold Sore Treatment; or (B) Send a hand-printed, self-addressed, properly stamped #10 envelope requesting a Game Card & Official Rules to: Abreva 100 Days of Summer Scratch & Win Game & Official Rules Request, PO Box 1169, Grand Rapids, MN 55745-1169 (VT residents only may omit return postage). Requests must be postmarked by 10/31/09, and received by 11/6/09. Limit of one (1) request per outer-stamped envelope. Typed, computer-generated, or otherwise mechanically reproduced requests or outer envelopes are not allowed. Entries become property of GlaxoSmithKline ("Sponsor") and will not be returned.
2. HOW TO PLAY: Each Game Card contains four (4) silver-covered ovals ("ovals"). Scratch off all four (4) ovals to see the number of Sunbursts saying "100 Days" ("Sunburst") that are revealed. The number of Sunbursts that are revealed will determine if you are a potential winner and the prize you will win, subject to verification of your Game Card. If your Game Card reveals four (4) Sunbursts, you are the potential Grand Prize Winner; if your Game Card reveals three (3) Sunbursts, you are a potential First Prize Winner; or, if your Game Card reveals two (2) Sunbursts, you are a potential Second Prize Winner. Any Game Cards containing only one (1) Sunburst are not winning Game Cards. All Game Cards are subject to verification. See Rule 4 below.
3. PRIZES & ODDS OF WINNING: GRAND PRIZE (1): One (1) Grand Prize Winner, after submission and verification of the Game Card, will receive a Florida Gulf Coast Trip for two consisting of roundtrip coach airfare from major airport closest to Winner's residence to St. Petersburg Beach, FL; 4 nights/5 days' hotel accommodations at Don Cesar Beach Resort® (a standard room; double occupancy); 5-day mid-size rental car; and five hundred dollars ($500) spending money. ARV: $6,400, depending on city of origin. If Grand Prize Winner resides within 250 miles of St. Pete Beach, the Grand Prize Winner will receive five hundred dollars ($500) car/mileage allowance in lieu of the roundtrip coach airfares. Grand Prize Winner and travel companion must travel together on same itinerary and possess necessary travel identification documents prior to ticketing. Trip must be completed prior to 6/30/10, or Prize will be forfeited in its entirety and Sponsor shall have no further obligation to Grand Prize Winner. Sponsor has no liability for Grand Prize Winner's inability to utilize Prize. All travel accommodations will be as determined by Sponsor, require a minimum of 30 days' advance notice and are subject to blackout periods and availability. Winner must be parent/legal guardian of a minor travel companion. If potential Winner is a minor in his/her state of residence, Prize will be awarded in name of his/her parent or legal guardian, who must sign all required documents. Grand Prize Winner must comply with all requirements of rental car company, including possession of a valid major credit card. All expenses not specified above, including but not limited to meals, beverages, mini-bar, souvenirs, personal expenses, gratuities, insurance, etc. are Winner's sole responsibility. All federal, state and local taxes are the sole responsibility of Grand Prize Winner. Potential Grand Prize Winner must sign and return Affidavit of Eligibility/Compliance (including his/her Social Security Number) & Publicity/Liability Release (potential Grand Prize Winner's travel companion must similarly sign and return Publicity/Liability Release), as allowed by law, by date specified in notification letter or Prize will be forfeited. Grand Prize Winner will receive a Form 1099, as required by law for tax reporting purposes. FIRST PRIZE (3): Three (3) First Prize Winners, after submission and verification of the Game Card, will each receive a Five Hundred Dollar ($500) Fossil® Gift Card that s/he may use for purchases of Fossil merchandise. ARV: $500 each. Gift Cards must be used in compliance with its terms and conditions and as allowed by law. First Prize Winners are solely responsible for the possession and/or use of his/her Card after being awarded the Card and Sponsor is not responsible for any misplaced, lost, or stolen Cards. SECOND PRIZE (100): One Hundred (100) Second Prize Winners, after submission and verification of the Game Card, will each receive a coupon for a free tube of Abreva Cold Sore Treatment. ARV: $18 each. Coupon must be used in compliance with its terms and conditions. NOTE: Regardless of Prize won, Prize is not redeemable for cash nor is it transferable or substitutable except by Sponsor with one of equal or greater value. Prize may not be redeemed for cash; nor is it transferable or substitutable except by Sponsor with one of equal or greater value. Federal, state and local taxes are the sole responsibility of the Winner. Total ARV of all Prizes: $9,700. Limit: One Prize per person or household address. Based on an anticipated maximum distribution of 300,000 Game Cards, the odds of winning a Grand Prize are 1:300,000; the odds of winning a First Prize are 1:100,000; the odds of winning a Second Prize are 1:3,000 and the odds of winning a Prize are 1:2,885. Unclaimed Prizes will be not be awarded.
4. HOW TO CLAIM A PRIZE: If the ovals you have scratched off on your Game Card reveal two (2), three (3) or four (4) Sunbursts as described above, you are a potential Winner of the respective Prize as described in Rules 2 and 3 above, subject to submission and verification. Please securely staple your Game Card to an 8½" x 11" sheet of paper on which you have hand-printed and signed your name, complete address, and daytime telephone number ("Game Card Submission"), and send it in a properly stamped #10 envelope, no later than 12/4/09, to: Prize Claim - Abreva 100 Days of Summer Prize Claim, PO Box 1145, Grand Rapids, MN 55745-1145 (keep a photocopy of the Game Card Submission for your records). NOTE: Grand and First Prize Claims must be sent by registered, certified mail or other traceable service provider. All Prize claims must be received by 12/11/09 or they will be forfeited.
5. VERIFICATION: All Game Cards are subject to verification prior to award of Prize. Potential winning Game Cards are null and void and will be rejected if not obtained in accordance with these Official Rules and through legitimate channels, or if any part is determined by Sponsor or its independent representatives, whose decisions will be final in all matters relating to this Game, to be illegible, reproduced, counterfeited, mutilated, altered, or tampered with in any way, or if any Game Card contains printing, production, typographical, mechanical, or other errors. Any person(s) attempting to forge Game Cards or any attempt to win by fraud in any manner may be prosecuted. Liability for a Game Card containing printing or other errors is limited to replacement with another Game Card, while supplies last. The number of Prizes awarded will be limited to those stated in these Rules. In the event of a printing or other error resulting in more winning Game Cards than the number of Prizes as stated in these Official Rules, a random drawing will be held among those holding such Game Cards to award the number of Prizes as stated in these Official Rules.
6. ELIGIBILITY: This promotion is open to all legal residents of the 50 United States and the District of Columbia, 18 years or older, except officers, directors, and employees (and members of their household and of their immediate families, i.e., parents, children, stepchildren, spouse, siblings and persons residing in the same household of such immediate family members) of Sponsor, its subsidiaries, affiliates, sales representatives, distributors, advertising/promotion agencies, and/or their affiliates, assigns or representatives (herein after referred to collectively as "Sponsor & Others"), and all other persons or entities associated with the development, administration, promotion, execution of, or supply to, this Game.
7. GENERAL: By participating in this promotion, entrants agree to be bound by these Official Rules. By accepting Prize, each Winner grants Sponsor the right to use his/her individual name, address, photograph, and likeness for advertising, publicity & promotion purposes and for any other such purposes as Sponsor so determines, in any and all media worldwide without limitation, without further compensation or permission, except where prohibited by law. Sponsor & Others are not responsible for any liability, whether directly or indirectly, including, without limitation, liability in connection with any injuries, damages or losses of any kind, whether direct or indirect, whether to property or person, including death, arising out of the acceptance, use and/or misuse of the Prize and/or participation in this Game; and they will be held harmless against any claims of liability arising directly or indirectly from any Prizes awarded. Sponsor is not responsible for postage-due, late, lost, counterfeited, illegible or tampered entries/mail. The interpretation of these Official Rules shall be governed by the laws of the Commonwealth of Pennsylvania. Any and all disputes, claims and causes of action arising out of, or connected with, the Game or any Prize awarded shall be resolved individually, and without resort to class action, in the appropriate courts in the Commonwealth of Pennsylvania exclusively. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or a party's rights and obligations, shall be governed by, and construed in accordance with, the laws of the Commonwealth of Pennsylvania, without giving effect to any choice of law or conflict of law rules of any other jurisdiction. All federal, state and local laws and regulations apply. Void in Puerto Rico and where prohibited or restricted by law.
